The Harrison

During the last session of the Court of Common Pleas for this county, which
commenced on Tuesday last, two separate bills of indictment were found against
David Hermitage and David Vleet. The first against David Hermitage "for horse
stealing, and against David Vleet as accessory, before the fact, to the felony
and larceny." The second against David Hermitage " for horse stealing, and
against David Vleet for harboring him, knowing him to be a thief". Hermitage
was tried and convicted in both cases. But Vleets case was continued, in
consequence of a motion by his council to have the case delayed until an
application could be made to the Supreme court to have the trial removed to
another county, under a plea that public
Excitement was too much against him to admit of a fair trial in this county.
The whole prosecution rested on the testimony of Wm. H. Gardner, whose character
was not impeached by any evidence before the court, although several witnesses
had been summoned for that purpose.
Yesterday afternoon Hermitage was brought into open court, and was sentenced to
five year's imprisonment in the Penitentiary on each conviction -- one month in
each year to the cells.
We have given a copy of sundry papers on the second page of this paper to show
the means by which Mr. Garner became an evidence in these
Cases

FOR THE TELEGRAPH
THE friends of John C. WRIGHT having calumniated the character of Walter B.
BEEBE by circulating a report that he impeded the organization of the militia
during the last war, by advising those drafted from the performance of a tour of
duty. W. B. BEEBE'S friends have procured the following certificates, one from
a person generally known in Harrison county, and the other from a citizen of
Kentucky, where our district elections cannot be supposed to influence the
conduct; a mere reading will show the measures pursued by his opponents. The
originals are left with the editors of the Harrison Telegraph for inspection.
Sate of Ohio, Harrison County
This eighteenth day of September A.D. 1824, Personally appeared before me, the
undersigned, a Justice of the Peace in and for said Harrison County, CHARLES
CHAPMAN, ESQ. who being duly sworn doth depose and say, that he, the said
Chapman, during the late war did and now does reside in the town of Cadiz, in
said Harrison County, and was, during said war, drafted to perform a tour of
military duty in the service of the United States; and judging the said draft to
be illegal and in no way made by the officers according to law, he, the said
Chapman, applied to Walter B. BEEBE, Esq. for his opinion as to the legality of
the draft. --- And this deponent further states, that said BEEBE counseled and
advised this deponent to perform his tour of duty in the service of the United
Sates; and this deponent did by the council and advice of the said BEEBE perform
his tour of duty by hiring a substitute at a high price who performed said tour
in his place.
This deponent further states, that he well knows, and remembers, that the said
BEEBE gave similar counsel and advice to several others that were drafted, who
also performed their tours of duty by reason of the said BEEBE'S advice, and
further this deponent says not.
